  • March 11 - Pursuant to §§ 23.09 (2) (intro), 23.091, 23.11 (1), 23.22 (2) (a) and (b) 6., 23.28 (3), 27.01 (2) (j), 29.014 (1), 29.039 (1) 29.041, and 227.11 (2) (a), Wis. Stats., interpreting s. 23.22 (2) (a), Stats., the Department of Natural Resources will hold a public hearing on proposed revisions to ch. NR 40, Wis. Adm. Code, relating to the identification, classification and control of invasive species at 10 a.m. in Room G-09, of the State Natural Resources Building (GEF 2), 101 S. Webster St., Madison. The proposed rule makes several “housekeeping” changes to ch. NR 40 relating to the identification, classification and control of invasive species, including: creates a definition for the term “aquatic invasive species; revises the current definitions of “established ” and “propagules,” to clarify that they apply to organisms other than plants, such as disease-causing microorganisms; revise the descriptions of the boundary lines for 6 split-listed invasive plant species (i.e., plants that are listed both as “prohibited” in one part of the state and as “restricted” in another part of the state); corrects the scientific name of snakehead fish and makes other corrections for species scientific names; create or amend informational Notes to various provisions of ch. NR 40; revises the current bans in ch. NR 40 on the highway transport or launching of any vehicle, boat, boat trailer or other equipment that has an aquatic plant or aquatic animal attached; and removes an unnecessary regulatory permit requirement that duplicated an existing statutory requirement relating to the introduction of nonnative aquatic plants. The department has made a preliminary determination that this action does not involve significant adverse environmental effects and does not need an environmental analysis under ch. NR 150, Wis. Adm. Code. However, based on the comments received, the department may prepare an environmental analysis before proceeding with the proposal. This environmental review document would summarize the department’s consideration of the impacts of the proposal and reasonable alternatives. Pursuant to §. 227.114, Stats., the proposed rule may have an impact on small businesses including the plant nursery industry, seed and agriculture industries, fish farmers, bait dealers, aquarium and ornamental fish dealers, businesses that own or manage land, and commercial fishers, but is not expected to have a significant adverse effect on a substantial number of small businesses and may have favorable effects on a number of businesses by correcting and clarifying existing rules and by adding informational Notes to ch. NR 40. The proposed rule and fiscal estimate may be reviewed and comments electronically submitted at the Wisconsin Administrative Rules Web site.   • March 12 - Pursuant to §§ 227.16 and 227.17, Wis. Stats., the Department of Natural Resources will hold a public hearing on creating § NR 400.02(162)(a)51 and 52, relating to the definition of volatile organic compound (VOC) at 1 p.m. in Room G09 of the State Natural Resources Building (GEF 2), 101 S. Webster St., Madison. The proposed revisions relate to issues for State Implementation Plan approvability, and the State Implementation Plan developed under § 285.11(6), Stats., will be revised. The proposed rule amendment contained in this order reflects a recent conclusion by the United States Environmental Protection Agency (EPA) that dimethyl carbonate and propylene carbonate make a negligible contribution to tropospheric ozone formation. EPA excluded these two compounds from its regulatory definition of VOC through a January 21, 2009 Federal Register notice (74 FR 3437). Currently, § NR 400.02(162)(a), Wis. Adm. Code, lists 50 compounds that are excluded from the state regulatory definition of VOC. The Department is proposing to add dimethyl carbonate and propylene carbonate to this list to ensure consistency between state and federal definitions of VOC. The proposed rule amendment may create an incentive for certain entities, such as paint and coating manufacturers, to use these compounds in place of other more highly reactive organic compounds thereby potentially reducing ground-level ozone concentrations. The proposed rule and supporting documents, including the fiscal estimate, may be viewed and downloaded from the Wisconsin Administrative Rules Web site, which can be accessed through the link provided on the Proposed Air Pollution Control Rules Calendar. The department has made a preliminary determination that adoption of the proposed rules would not involve significant adverse environmental effects and would not need an environmental analysis under ch. NR 150, Wis. Adm. Code. However, based on comments received, an environmental analysis may be prepared before proceeding. This analysis would summarize the Department’s consideration of the impacts of the proposal and any reasonable alternatives. Comments on the proposed rule must be received on or before Monday, March 22, 2010.   • March 18 - Pursuant to § 283.49, Wis. Stats., a public hearing for the purpose of giving all interested persons an opportunity to make a statement with respect to the proposed permit issuance and Environmental Assesment for Wisconsin Pollutant Discharge Elimination System (WPDES) Permit No. WI0063878-01 for Roth Feeder Pig Inc., located in SEQ SWQ T7N R4W Section 2, Town of Wauzeka, Crawford County with discharge to Boydtown Creek and the Lower Wisconsin River Basin will be held at 1 pm., Wauzeka Town Hall, 304 East Front St., Wauzeka. Roth Feeder Pig is a hog operation planning to operate with approximately 1724 Animal Units, consisting of about 6,000 animals (piglets, sows, boars). All manure will be stored in concrete tanks. The facility has between 18 months and two years manure storage capacity and will operate under an approved Nutrient Management Plan covering 180 acres. The WPDES Permit requires routine monitoring and reporting and includes compliance schedules concerning manure storage construction and lagoon abandonment. Pursuant to s. NR 150.03 (8)(i) 2., Wis. Adm. Code, the Roth Feeder Pig requirement for a WPDES Permit makes this a Type 2 action, requiring an Environmental Assessment (EA). A draft EA has been prepared and concludes that the proposed action is not expected to result in significant adverse environmental effects. The department has made a preliminary determination that an environmental impact statement will not be required. This notification is in compliance with Wisconsin Environmental Policy Act (WEPA), s. 1.11, Wis. Stats., and ch. NR 150.   • March 24 - Pursuant to §§ 285.13(1), 285.61(7)(a) and 285.62(5)(a), Wis. Stats., the Department of Natural Resources will hold a public hearing to receive public comments on the air pollution construction and operation permit revision applications of United Ethanol, LLC at 1: 30 p.m., at the Milton City Hall; Council Chambers (Lower Level), 430 E. High St., Milton. United Ethanol, LLC, 1250 Chicago Street, Milton, Rock County (FID 154144540), submitted to the DNR a permit application, including plans and specifications for a construction permit revision and a significant operation permit revision for a fuel grade ethanol production facility. (Air Pollution Control Construction Permit: 07-DCF-239-R1; Air Pollution Control Operation Permit: 154144540-F03). DNR has made a preliminary determination that portions of the application meet state and federal air pollution control requirements and that the revised permit should be approved.   • April 1 - Pursuant to Wis. Stat. § 227.44(4)(b), a telephone prehearing conference in the matter of the petition for a contested case hearing on WPDES Permit No. WI-0063959-01-0 issued to Rosendale Dairy, LLC is scheduled for, at 11 a.m. to allow the case to be consolidated. The parties have stipulated that the pending permit modification case can be consolidated with this matter if an appeal is filed.   • April 13 - Pursuant to Wis. Stat. §§ 30.12(3m) and 30.209 and Wis. Admin. Code NR 2 and 326 a Class 1 contested case public hearing in the matter of the denial of an application by Hayward Ten T3, LLC for a pier permit located on Lake Hayward in the City of Hayward, Sawyer County will be held at 12:30 p.m., in the Assembly Room at the Sawyer County Courthouse, 10610 Main Street, Hayward. Hayward Ten T3, LLC, applied to the Department of Natural Resources for a permit to place twin piers with three fingers each and a common lateral connecting dock on Lake Hayward. The proposed 12 slip pier would be used for boat mooring and recreation. Ten of the proposed slips would be designated for condo townhomes; two slips would be for swimming, fishing and beach access, as well as for temporary boat mooring for visitors. The proposed project piers would be removable and on post stands and modular in nature, with standard 5’ x 20’ aluminum frame and wood decking. The proposed piers would contain floats and would be in the water during the boating season. The proposed project is located in the City of Hayward, Sawyer County also described as in the SE ¼ of the NE ¼ of Section 27, Township 41 North, Range 9 West. On June 22, 2009, the Department of Natural Resources denied Hayward Ten T3, LLC’s permit application to place a pier/wharf on the bed of Lake Hayward. On July 13, 2009, the Department received a Request for Contested Case Hearing from Randy M. Lund on behalf of Hayward Ten T3, LLC. On August 13, 2009, the Department granted a contested case hearing pursuant to Wis. Stat. §§ 30.12(3m), 30.209 and 227.42. On January 6, 2010, the Division of Hearings and Appeals received the Request for Hearing from the Department of Natural Resources.   • April 14 - Pursuant to §§ 77.06(2), 77.82(2m) and (4), 77.88(2)(d)2., 77.91 (1) and 227.11 (2)(a), Wis. Stats., interpreting §§ 77.06(2) and subch. VI of ch. 77, Wis. Stats., the Department of Natural Resources will hold a public hearing on revisions to ch. NR 46, Wis. Adm. Code, relating to the administration of the Forest Crop Law and the Managed Forest Law. Video conference participation will be available at 10 a.m. at the University of Wisconsin- Madison Pyle Center, 702 Langdon St., Madison, and in Room 211, Communication Art Center (CAC), UW-Stevens Point, 1101 Reserve St. Stevens Point. The proposed rule:
    1. Revises the annual stumpage rates for the period between Nov. 1, 2010 and Oct. 31, 2011 as required in §§ 77.06(2) and 77.91(1), Wis. Stats. The average change from the current rate is a 3 percent decrease in saw timber, a 4 percent decrease for pulpwood, a 3 percent decrease for mixed products, and a 1 percent increase in piece products.
    2. Create an exemption for payment to f forest crop law termination taxes if land ownership changes have occurred after the original landowner received notification of forest crop law expiration and new landowner certifies intent to enter into the managed forest law program.
    3. Clarify the requirements for additions to existing managed forest law lands.
    4. Amend the certified plan writer reporting requirements for plan preparation costs and requirements for making an offer to landowners for management plan writing services. Amend the department billing requirements when invoicing landowner for plan preparation fees.
    5. Amend the stocking requirements for management of plantations.

  • April 19 - Pursuant to §§ 30.12, 30.19, 30.20, 30.209 and 227.42 Wis. Stats., a Class 1 contested case public hearing in the matter of the application by the Village of Egg Harbor for an amendment to its permit to place marina piers on, dredge, and grade over 10,000 square feet on the bank of Green Bay, located in the Village of Egg Harbor, Door County, will commence at 11 a.m. in the Friends Room at the Door County Library, 107 South 4th Avenue, Sturgeon Bay. The Village of Egg Harbor, 7860 Highway 42, Egg Harbor, Wisconsin, 54209, applied to the Department of Natural Resources (the Department) for an amendment to its permit to place marina piers, and dredge on the bed, and grade over 10,000 square feet on the bank of Green Bay. The proposed project is located in the Village of Egg Harbor, Door County, at 7815 Dock Road, also described as Section 25, Township 30 North, Range 26 East. The Department of Natural Resources approved the Village of Egg Harbor’s amended permit application with certain conditions and limitations. The department received a petition for a contested case hearing and request for a stay from Attorney Winston A. Ostrow on behalf of the Peninsula Shores Condominium Association, Inc., with the following disputed issues of material fact:
    1. Impacts on Navigation: What additional adverse impacts, if any, will extending two floating piers 20 feet further south up to the extended property line and mooring boats to the end of the piers have on the ability of the public (including Peninsula Shores owners) to safely navigate and exercise incidents of navigation in the area of Green Bay south of the extended property line?
    2. Impacts on Natural Scenic Beauty: What additional adverse impacts, if any, will extending two floating piers 20 feet further south up to the extended property line and mooring boats to the end of the piers have on natural scenic beauty in the area of Green Bay south of the extended property line?

Meetings

  • March 8, 9, 10, 11, 15, 16 & 18 - The 2010 Wisconsin Deer Management Unit information meetings will be held around the state. All meetings will open with a 15-minute video hosted by Scott Craven of the University of Wisconsin who will lead an informal round table discussion on emerging harvest patterns, Deer Management Unit-specific management, hunter surveys and a CWD update. Attendees will also learn about preliminary deer population estimates, possible deer hunting season structures for 2010, and unit level CWD status and historical perspectives of deer management. Some new DNR communications tools will be announced and attendees will learn more about how they can be involved in the research initiatives.
  • March 9-10 - The DNR Fire Department Advisory Council will meet at 12:30 p.m. March 9 and 8 a.m. March 10 at theAldo Leopold Center, E13701 Levee Road, Baraboo, regarding forestry strategic plans, forest fire program assessments, forest fire protection grants, and other related topics.   • March 10 – A Rock River TMDL Implementation Planning meeting will be held from 1-4 p.m. at the Lake Mills Community Center, 200 Water St., Lake Mills. Currently, the Wisconsin Department of Natural Resources and the United States Environmental Protection Agency are working together to develop a Total Maximum Daily Load or TMDL for sediment and phosphorus that enters the Rock River and its tributaries. A TMDL is a quantitative analysis that determines the amount of pollution each waterbody in the basin can assimilate from both point and non-point sources while still meeting water quality standards. Waterbodies in the basin with excessive phosphorus and sediment levels will be targeted for restoration efforts. The TMDL analysis is scheduled for completion in July, 2010. In anticipation of these results, the Rock River TMDL Implementation Plan Team is in the early stages of developing a strategy for how to best develop a recovery plan for the basin. To help us determine how to develop the plan, and then help write the plan, the DNR is organizing a team composed of five technical sector teams: agriculture, urban stormwater, municipal and industrial wastewater, communication/outreach, and assessment. The sector teams will be technical work teams with a specific focus on developing ways to reduce pollution from a particular source type. We are estimating that the process to develop a plan will take about two years. This meeting is being held to explain this process, to entertain suggestions on the best methods to develop the plan, and for people to learn about and consider becoming, a sector team member.   • March 10 - Mid-Kettle Moraine Partners Group, consisting of individuals representing governments, private nonprofit conservation agencies and others interested in the Mid-Kettle Moraine will meet at 9 a.m. at the Southeastern Wisconsin Regional Planning Commission, W239 N1812 Rockwood Drive, Waukesha, to discuss strategic direction for the Partners Group for the next five years and share information on the activities of the Partners Group.   • March 16 - The Peshtigo River State Forest will hold their spring public meeting at 6:30 p.m. at the forest office, located at N10008 Paust Lane, Crivitz, (about 15 miles northwest of Crivitz). The purpose of the meeting is to report to the public what management activities have occurred in the past year and what is planned for the upcoming year. The topics being addressed at this meeting are related to boat landings, camping, the use of ATVs and golf carts, law enforcement, and timber harvesting. There will also be a report regarding the construction of the new office and maintenance building, which will be shared with the Governor Thompson State Park.
